CURRENT TERMS OF SERVICE

1. General Terms and Conditions

These terms and conditions apply to the commercial relationship between Finanime Sekai (Torivoudintie 3, 00640 Helsinki, business ID 2787109-2, asiakaspalvelu@finanime.fi, later Finanime) and its customers.

The terms and conditions specified by the service provider in question also apply to the services and products provided by Finanime. Finanime reserves the right to update these terms and conditions without prior notice. Orders are subject to the terms and conditions in force at the time of ordering, which are available on Finanime's website. Translation versions are available, in case of differences of interpretation or other differences between the versions, the Finnish version will prevail.

Finanime is not liable for damage caused by force majeure. Force majeure is considered to be an unforeseeable circumstance or change in circumstances beyond the control of Finanime.

2. Customer and Privacy

Finanime's products and online shop are aimed at hobbyists, not retailers. The commercial relationship is governed by the applicable Finnish and EU legislation. Children under 15 years of age are not allowed to be Finanime customers, a minor customer needs the consent of his/her guardian to place an order.

When placing an order, the customer gives his/her consent to the processing of the necessary personal data in accordance with the EU General Data Protection Regulation. When placing an order, the customer is obliged to provide complete and correct contact information, including at least name, address, telephone number and e-mail address.

Customer data is stored in Finanime's customer register, where the data is used to maintain the customer relationship between Finanime and the customer. The data is not used for direct marketing - only for normal communication in the customer relationship. At no time will the data be disclosed outside Finanime, except in matters relating to collection or billing and where specifically required by law. We will always inform the enquiring party/customer immediately if any private party or public authority asks us for information about an individual customer and we will never disclose information without a final court order. Personal data will not be transferred outside the European Union. If the customer (natural person) wishes, he/she can register and create a user account for the service, in which the information entered must be accurate. Only one user account per natural person at a time is allowed. Finanime reserves the right to full control of the system, including (but not limited to) the right to delete an account without prior notice or to terminate the service completely. It is the Customer's responsibility to keep their account username and password in a safe place and not to disclose them to any third party, Finanime staff or administration will not know and will never ask the Customer for their account password.

The customer can check his/her personal information by contacting Finanime's customer service. Any contact must be made in writing and signed and delivered to Finanime Sekai, Torivoudintie 3, Business premises 2, 00640 Helsinki. Our register description in accordance with the Personal Data Act is available at from here. The customer can at any time manage their own data and request their immediate and permanent removal Finanime's information systems, unless legislation, open invoices or collection actions prevent the deletion of data.

Finanime's website may use cookies to help make the website more user-friendly. The purpose of cookies is to enable, facilitate, improve and speed up the business experience. Cookies can also be used to provide better offers and more personalized product recommendations to the customer.

Finanime offers its customers the opportunity to subscribe to a free newsletter, which will be delivered by e-mail. In connection with the order, only information about the e-mail address is collected, and in order to prevent misuse, it is also technically confirmed that the subscriber has access to the specified e-mail address before starting the distribution. The customer can unsubscribe from the newsletter at any time by clicking the unsubscribe button in the newsletter. Finanime reserves all rights to the newsletter and its contents and reserves the right not to publish the newsletter without notice. The subscriber of the K18 version declares that he is of legal age when placing the order.

3. Pricing

Prices include VAT and delivery by Posti Oy on the customer's behalf in Finland, to a collection point of the customer's choice, alternatively to a location chosen by Posti Oy or, at Finanime's discretion, to a delivery address in the case of daily delivery. For orders of less than EUR 20, a delivery charge of EUR 2.90 will be added. The Customer is always responsible for ensuring that the address details are correct and for informing Finanima of any changes to the address details after placing the order, on a voluntary basis and on a per-order basis, and the order will always be delivered on the basis of the address details provided by the Customer at the time of the order. The Customer shall be liable for any costs incurred in re-routing the shipment due to incorrect information. (Note! Changes made to your customer account information will not automatically carry over or affect previous subscriptions! Finanime doesn't actively or automatically monitor or, without good reason, process customer account information or changes to it.))

Prices do not include any additional Post Office services that the customer may have taken (including but not limited to: postage paid, home delivery, breakable). We do not generally deliver outside the EU, for delivery to other EU countries an additional delivery charge will be added to the price on delivery. If there are obvious price errors in the price list, the product will not be sold at a significantly lower price if it can be assumed that the customer has understood the existence of the error.

We check prices at the time of order processing. If the price of the product rises before the order is shipped, we will deliver them at the original price.

Any delivery time estimates are indicative and are based on information provided by suppliers. Finanime or the suppliers it uses are not responsible for delays caused by unforeseen changes outside its scope. Finanime does not sell its products for resale.

The age limits of the products are observed as prescribed by law. Ordering K-18 products requires confirmation of legal age for Finanime.

4. Delivery

We aim to process your order within two working days of receiving it. An order in this context means an order for which all products are immediately available in our warehouse and payment for the order has been accepted. In the event of incorrect or malicious orders, Finanime expressly reserves the right to refuse delivery of orders until the doubts have been clarified, if necessary in cooperation with the authorities.

Finanime is not obliged to reserve other products of the same order to the customer if the availability of one product is poor or its delivery is delayed for reasons beyond the control of Finanime. Alternatively, the customer can accept either post-delivery of the delayed product or cancellation of the order. Any postage for postage will be charged separately. The products in the order will be reserved for a maximum of 7 days, in which case the order will be canceled unless the customer has agreed to post-delivery in accordance with Finanime's terms.

5. Pre-orders

Finanime provides the customer with a pre-order system that allows the customer to reserve a product for ordering prior to its release. Finanime expressly reserves all rights to control its pre-order system, including but not limited to the control of access rights.

The pre-order is binding. As a rule*, no advance payment is requested for a reservation made through the pre-order system, but advance orders are paid later when the product arrives at the supplier's warehouse, allowing the order to be delivered within a reasonable time after payment (delays beyond Finanime's control, e.g. due to the supplier and the carrier, may affect the delivery time). If the customer wishes to pay for the pre-order in advance of delivery, the customer may contact Finanime in which case the payment method will primarily be arranged by the normal technical means available in the online shop.

*In the case of advance orders, part of the payment will be requested in advance as a non-refundable deposit in case of cancellation due to reasons attributable to the customer. These products are ordered separately for the customer, the procedure is always clearly indicated on the product page and the advance is confirmed only after the prepayment has been made. Postal orders are not suitable as a means of payment for prepayments.

If the customer wishes to cancel his/her pre-order, the customer must contact Finanime in writing, for example by e-mail including the pre-order number or by replying to the pre-order confirmation message while maintaining the previous message chain. The cancellation of one or more pre-orders by the Customer may result in, among other things, but not limited to, the restriction or loss of access to the Finanime pre-order system.

Finanime reserves the right to cancel a pre-order in the event of force majeure (for example, if the manufacturer is unable to supply a sufficient number of products to resellers and some or all of the reservations have to be cancelled, or if the licensing changes and sales are not possible in Finland). Finanime will immediately inform the customers whose reservations are affected.

Finanime reserves the right to ask the customer to identify themselves via a payment transaction. Confirmation is requested only in exceptional cases where the customer's purchasing behavior is atypical; the procedure excludes, for example, the suspicion of a fraudulent offense (deliberately placed in the name of another) and thus contributes to the safety of customers. In this case, the customer must make a payment of one (1) euro using an invoice sent by Finanime, a link, a secure product page or a payment method provided in another way, using the Visma Pay payment method. After a successful payment transaction, Finanime will immediately refund the payment to the payment instrument used by the customer and pre-orders may be accepted at its discretion.

In the event of cancellation, Finanime reserves the right to charge compensation for the costs already incurred for the processing of the order in accordance with Chapter 6, Section 19, paragraph 1 of the Consumer Protection Act. The basis for the costs shall be determined and based on the costs already incurred for the preparation of the order prior to its dispatch (including but not limited to the reception of the order, the processing of data, the work spent on processing the order books of suppliers/manufacturers, and other costs already incurred prior to the moment of cancellation).

6. Payment

Finanime's payment providers are Visma Payments Oy, PayPal and Klarna.

Through Visma Pay, you can pay with your online banking ID, wallet, payment cards (credit/debit), invoice or instalment. The following payment methods are available.

MobilePay: You can pay with your MobilePay wallet if you have allowed online shopping to pay for the app settings. Payments made with MobilePay will be charged to the debit card attached to the wallet. If it is not possible to charge the payment card, it will not be possible to pay with the MobilePay wallet in the online store.

Alisa Invoice is a flexible and secure payment method. It is suitable for all consumers over the age of 20 for all types of purchases. Cancellations and returns

The customer has a right of withdrawal of 14 days in accordance with the law. If the customer wishes to cancel his order and return the product, he must first contact us without delay, preferably by e-mail to asiakaspalvelu@finanime.fi. We will provide instructions on how to return the product in the reply message, the postage costs for returning a faultless product will be borne by the customer. When returning the product, please remember to mark the return as "customer return".

Products purchased new must be unused and unopened in their sales packaging, products purchased used must still be in the same condition as when they were delivered to the customer.

We ask the customer to keep all documents related to the customer return carefully until Finanime has been notified that the return has been received. By law, the customer must make the return without delay, but no later than 14 days after receiving the instructions.

Restrictions on the right of return are determined in accordance with Chapter 6, Section 16 of the Consumer Protection Act.

Games, movies, software, collectible cards / posters packaged by the manufacturer in “random order” or other similar sealed products are non-refundable once the product packaging has been opened.

Hygiene and intimate products do not have a right of return after opening the package, as the product is not returnable for sale due to its nature. Hygiene and intimate products include e.g. headphones, bedding, towels and other textiles.

Service products or digital content do not have a right of withdrawal under the Consumer Protection Act if the service has been started or the electronic delivery of digital content has been started after the customer has given his consent to the start of the delivery.

Returned products must be carefully packed, and the customer is responsible for the direct costs of returning the goods in accordance with the price list of the carrier of their choice. An unclaimed package is not an exercise of the customer refund/cancellation right. In case of return of an uncollected order, the customer will be charged the actual postage and handling costs of the return, but not less than €10.90.If the charges are not paid, Finanime will no longer deliver orders to the customer. Finanime does not have a permanent branch open on a regular basis where the customer can bring the return in person or through another agent, but the Oulunkylä pick-up point can be used to make the return during opening hours and according to the booking situation.

Finanime reserves the right to charge and deduct from the refund the costs already incurred for initiating the processing of the order in accordance with Chapter 6, Section 19, paragraph 1 of the Consumer Protection Act. The basis for the charges will be determined and based on the costs already incurred for the preparation of the order prior to dispatch (including commissions of the payment method provider of the customer's choice, the work involved in receiving the order and processing the information, packaging work and supplies if the order has been completed and other costs already incurred prior to the time of cancellation).

8. Warranty, Support and Liability for Defects

The warranty is subject to the warranty conditions specified by the manufacturer. The customer is obliged to read the warranty conditions supplied with the product before using the product. Warranty conditions can be found in the operating instructions, a separate warranty form or the web address provided by the manufacturer. The warranty only covers defects in workmanship and materials in the product, and does not cover normal wear and tear. The warranty period is specified in the product information. If the warranty period is not specified in the product information, it is one year (12 months) from the date of purchase.

Warranty repairs are always carried out in accordance with the manufacturer's or importer's warranty conditions

The responsibility for digital recordings is always determined by the risk liability. Finanime is not responsible for data or software stored on digital media where the customer is responsible for the risk. Backup is the responsibility of the buyer.

9. Complaint

The customer is obliged to present a proof of purchase, receipt or other proof of the place and time of purchase in connection with the return or when claiming a defect in the goods. Finanime reserves the right to charge the buyer for the costs of searching for a receipt.

Complaints will only be processed in writing. A free-form complaint can be submitted either by e-mail to asiakaspalvelu@finanime.fi or by letter. The website has the option to leave customer feedback.

Dispute Resolution and Jurisdiction: The Consumer Customer shall have the right to submit any dispute arising out of this Agreement to the Consumer Disputes Board (www.kuluttajariita.fi) to be resolved. Before taking the matter to the Consumer Disputes Board, the consumer should contact the Consumer Advice Bureau (www.kuluttajaneuvonta.fi). The customer may bring an action against Finanime concerning disputes arising from the contractual relationship, either in the district court of Finanime's domicile or in the district court of the locality in whose jurisdiction he resides. If the Customer is not domiciled in Finland, disputes will be handled in the district court of Finanime's domicile.

Attorney's fees are not reimbursed. The Consumer Advice and Consumer Disputes Board provides assistance in resolving disputes free of charge.
